Terms of Service

Elevations (elevations.ongrid.design) is an online studio tool operated by M/s Utopian Fold, the firm behind Ongrid — India's online architecture studio. These terms set out the deal between you and us when you use the service. They are written to be plain. They are still a contract under Indian law.

1. Acceptance of these terms

By creating an account, generating an elevation, purchasing credits, or otherwise using Elevations, you agree to these Terms of Service, our Privacy Policy, our Refund & Cancellation Policy, and our Disclaimer. If you do not agree with any part of them, please do not use the service. These terms constitute an electronic record under the Information Technology Act, 2000 and the rules made under it, and do not require a physical or digital signature.

2. Eligibility

You must be at least 18 years of age and competent to enter into a binding contract under the Indian Contract Act, 1872. By creating an account, you confirm that you meet both requirements and that the information you give us is true. Elevations is offered to individuals; if you are using it on behalf of an organisation, you confirm you have the authority to bind that organisation to these terms.

3. Your account

• One person, one account. Don't create extra accounts to evade rate limits or stack free credits. We watch for this and will suspend duplicates.
• You are responsible for keeping your password safe. We hash passwords with PBKDF2 and never store them in plain text, but we cannot recover what we cannot see.
• Notify us at hello@ongrid.design the moment you suspect unauthorised access. We will help you secure the account.
• You may delete your account at any time from /profile (scroll to "Permanent actions"). The action is immediate — your personally identifiable data is scrubbed the moment you confirm. See Privacy §14 for the full retention schedule.

4. Acceptable use

When you use Elevations, you agree not to:

• Use bots, scrapers, or any automated tooling against the service, other than what we explicitly publish as an API.
• Resell, sublicense, or white-label the service or its outputs as your own product.
• Reverse engineer, probe, or attempt to bypass Cloudflare Turnstile, our rate limits, or any other security layer.
• Generate content that is unlawful, defamatory, obscene, infringes any third party's intellectual property, depicts a real private property without right, or is otherwise prohibited by Rule 3 of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
• Use the service to harass, mislead, or deceive any person.
• Attempt to extract, copy, or recreate the underlying prompts, models, or training data.

5. Credits and payments

• The free tier gives you three generations a day at 1K resolution, forever, without a card.
• Credit packs (₹49 / ₹399 / ₹799 / ₹1499) are one-time purchases. They are not subscriptions and they do not auto-renew. You will never be charged something you did not click to buy.
• Credits do not expire. They sit in your account until you use them.
• All prices are in Indian Rupees and are inclusive of applicable Goods and Services Tax (GST). We will issue a tax invoice on request.
• Payments are processed by Razorpay Software Private Limited, an authorised payment aggregator regulated by the Reserve Bank of India. We never see or store your full card number, UPI handle, or bank credentials.
• Refunds, where applicable, are governed by our Refund & Cancellation Policy.

6. Generated content and ownership

• You own what you make. Subject to your compliance with these terms, you keep all rights, title, and interest in the elevations you generate, and you may use them for personal or commercial purposes — client presentations, social media, your own builder, anything legal.
• You should know that under Indian copyright law as it stands today, the copyright status of work generated solely by an AI system, with no human creative input beyond a prompt, is unsettled. We grant you whatever rights we hold, but we cannot guarantee what a court would say about a purely AI-generated image.
• You grant us a non-exclusive, royalty-free licence to store your generations on Cloudflare R2 so we can serve them back to you, and to display them in anonymised, aggregated form in our public gallery and marketing — unless you opt out by emailing hello@ongrid.design.
• We do not use your personal account data, your Expert Report data, or your prompts to retrain any AI model. The image-generation vendors we use (named in the sub-processor table in our Privacy Policy) are contractually prohibited under their paid-tier API terms from training on the data we send.

7. Service levels

Elevations is offered on a reasonable-effort basis. We do not promise an uptime SLA, a specific generation quality, a fixed turnaround, or that any particular style or material combination will produce a particular result. AI image generation is inherently probabilistic. If a generation fails on our side, we automatically refund the credit (see clause 5 of our Refund Policy). Beyond that, we offer no warranty of any kind, express or implied, to the maximum extent permitted by law.

9. Third-party services

Elevations is built on top of services we do not own. Your use of the relevant feature is also governed by their terms:

• Google Gemini API — image generation (default for all tiers). Gemini API terms.
• OpenAI API — image generation when, and only when, you explicitly select the Drawings tier. By default no data is sent to OpenAI. OpenAI business terms.

• Cloudflare — hosting, Workers, R2, D1, Turnstile bot protection. Cloudflare terms.
• AWS Simple Email Service — transactional email from hello@ongrid.design. AWS service terms.

We are not responsible for outages, errors, or policy changes on the part of these providers, except to the extent we can reasonably mitigate them.

10. Suspension and termination

You may close your account at any time. We may suspend or terminate your account, with or without notice, if we reasonably believe you have breached these terms, abused free-tier limits, attempted payment fraud, or used the service to generate prohibited content. Where the breach is curable and the situation allows, we will reach out before suspending.

11. Limitation of liability

To the fullest extent permitted by law, M/s Utopian Fold and its directors, employees, and partners shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, goodwill, data, or business opportunity, arising out of or relating to your use of Elevations — even if we have been advised of the possibility of such damages. Our aggregate liability for any and all claims arising out of or relating to the service is limited to the amount you actually paid us in the twelve months preceding the claim, or ₹5,000, whichever is greater. Nothing in these terms excludes any liability that cannot be excluded under the Consumer Protection Act, 2019.

12. Indemnity

You agree to indemnify and hold M/s Utopian Fold harmless from any claim, demand, loss, or expense (including reasonable legal fees) brought by a third party arising from your breach of these terms, your misuse of the service, your construction or other real-world use of a generated image, or your infringement of any law or third-party right.

13. Governing law and jurisdiction

These terms are governed by the laws of India. Any dispute arising out of or in connection with the service shall first be attempted to be resolved amicably between the parties within thirty days of written notice. Failing that, the dispute shall be referred to a sole arbitrator appointed by M/s Utopian Fold under the Arbitration and Conciliation Act, 1996, with the seat and venue at Pune, Maharashtra. The courts at Pune shall have exclusive jurisdiction over any matter not subject to arbitration.

14. Changes to these terms

We may update these terms from time to time. Material changes will be notified to you by email at the address on file and by a notice on the site at least fifteen days before they take effect. Continued use of Elevations after the effective date means you accept the updated terms.
